Decree 35/2022/ND-CP has numerous progressive aspects in the management of industrial parks and economic zones, with the goal of removing roadblocks to attracting investment in industrial parks.

On the afternoon of August 26, Business Forum Magazine, a subsidiary of the Vietnam Confederation of Commerce and Industry (VCCI), hosted a forum on “Implementing Decree 35/2022/ND-CP on the management of industrial parks and economic zones, and awarding the certificate of voting for a typical industrial park in 2022.” According to the facts presented at the workshop, Vietnam now has 260 operational industrial parks and 75 under construction. Vietnam’s industrial park system attracts thousands of international enterprises from over 120 nations and territories globally.

According to data from the Ministry of Planning and Investment, in recent years, on average annually, foreign direct investment capital in industrial parks and economic zones accounts for about 35-40% of total FDI capital outside Vietnam. If only in the field of processing and manufacturing, foreign investment capital in industrial parks and economic zones accounts for 70-80% of the total registered capital of the whole country.

The establishment and development of industrial parks and economic zones is a key strategic objective for Vietnam in attracting foreign direct investment. plays a key role in increasing budget income, creating jobs, enhancing competitiveness, and hastening the country’s industrialization and modernization.

In order for industrial parks and economic zones to come into operation professionally, in May 2018, the Prime Minister issued Decree 82/2018/ND-CP stipulating the management of industrial parks and zones economy. However, after nearly 5 years of implementing the above decree, due to the deep integration of the global economy, some regulations on infrastructure planning for industrial parks and economic zones began to appear inadequate. .

According to Mr. Hoang Quang Phong – Vice President of the Vietnam Federation of Trade and Industry: “The Government’s promulgation of Decree No. 35 is a practical work, in line with the objective situation, in order to complete the implementation, improve and create momentum for the process of building a legal corridor, contribute to the formation of specialized, modern, green, clean industrial parks with full technical and social infrastructure”.

Opinions at the Forum highly appreciated the new points in Decree 34 on management of industrial parks and economic zones.

Appreciating the amendments of Decree 35, Ms. Tran Thi To Loan – Deputy General Director of Sao Do Group – said that: Compared with the previous Decree 82 on management of industrial parks, economic zones are related to: The issues of specific classification of industrial park construction planning, the role of the provincial People’s Committee, and investors are also focused. Localities are given more rights, in addition, the Decree also amends and supplements a number of regulations related to infrastructure investment.

“All these changes and modifications help save project implementation time, reduce costs for investors, and orient investors. In particular, avoiding the complicated and lengthy process of adjustment, which is currently causing difficulties for investors when implementing the project, because during the implementation process, there will be many problems that arise during the project’s establishment. In addition, Decree 35 has also clearly divided the types of industrial parks, including: Supporting industrial parks, specialized industrial parks, high-tech industrial parks, urban – service industrial parks.

Decree 82 does not specify the criteria for each type of industrial park, but just to update the legal corridor, Decree 35 has clearer legal guidance to help investors determine the direction of the industrial park. Be clear in the choice of investment location.

Meanwhile, according to lawyer Tran Dai Nghia – CEO of FIIVN, the policy of eco-industrial parks is the subject of very strict regulations in Decree 35. With the policy of sustainable development, the development of this model is encouraged. is very practical, which helps to realize the goal of saving energy, reducing sources of environmental pollution, especially reducing carbon emissions.

With many new points introduced in Decree 35, Prof., Dr. Dang Thi Kim Chi – Vice President of the Vietnam Association for Nature and Environment Protection – said that Decree 35 contributes to the improvement of policy mechanisms and policies. industrial parks, creating confidence for investors, businesses and people in green industrial park operation models, towards sustainable development in Vietnam, contributing to promoting the transformation of existing industrial parks to the eco-industrial park, increasing quality local jobs through improved working conditions, increased cohesion and enhanced community benefits and social responsibility towards the communities surrounding the industrial park. .

Within the framework of the Forum, the Organizing Committee awarded Certificates to Typical Industrial Parks in 2022. This is an annual event organized by the Business Forum in order to encourage and encourage industrial park investors who have already registered. creating green, clean industrial parks, fully meeting technical and social infrastructure. Out of a total of hundreds of industrial parks across the country, the Organizing Committee has selected 12 typical industrial parks in 2022, 4 industrial parks with outstanding criteria are: Environmentally friendly industrial park; industrial parks with typical safety infrastructure; industrial park with synchronous industrial and logistics infrastructure.
